Plastic bag ban not the answer
Two recent articles referenced local efforts to support a plastic bag ban for New Hanover County. Retailers, as much as consumers, are concerned about protecting the environment. While I applaud the sentiment, a ban is not the solution. The North Carolina Constitution prohibits regulation of commerce by local governments and so any county ordinance prohibiting retailers use of plastic bags would likely be unconstitutional. Similarly, the Constitution prohibits legislators from regulating commerce locally, instead requiring regulations to be implemented statewide -- to do otherwise creates a patchwork of laws from county to county. Many point to the Outer Banks plastic bag ban as a model, yet it is also likely unconstitutional although it has not been challenged in the courts. Regardless, the ban has not proven successful in changing consumer behavior. Retailers report that less than 5% of transactions in the Outer Banks involve reusable bags - consumers are choosing paper bags which pose similar environmental concerns.
